Question by treehugger_06: Can a lender agreeing to short sale keep you out of foreclosure?
My coworker is in short sale with his lender. I am familiar with the Mortgage Debt Relief Act of 2007, but I don’t know if he is in short sale trying to sell the property, if the bank can foreclosure in the process. He is about 2 months behind on the notes. He has about 20 more days before he’ll be 3 months. Does the fact that he is in short sale agreement with the lender keep him from foreclosing? I told him it is better if he can get the short sale to occur rather than foreclosing.

If all the lenders agree to go forward with a short sale agreement, that by definition supersedes a foreclosure action.

I know you can’t predict the future but have people been able to purchase homes through the bank after completing a short sale? Is a short sale credit suicide? I ask this because to qualify for one of these sale one must stop paying their mortgage for many months. Is this true?

Reports on how a short sale affects credit scores are all over the place. Some folks say 200-300 points and others say they have only taken a 85-100 point hit.

Lenders used to require that you be behind in payments before they would even consider a short sale, but this is not true anymore. Some lenders will consider a short sale even if you are current on your mortgage.

When you will qualify for another mortgage will depend on where your credit score ends up after the sale and the policies of the bank. The basic rule of thumb is it will be 2 years before any Fannie Mae lender will consider you again.

Question by Sara: Does the realtor help to get approved for a home loan or should we get approved and then approach one?

Rather Unfortunate, but it seems the Foreclosure Firestorm will only increase and compound itself throughout the summer. The Alt-A loans will be resetting also, so a large bulk of soon to be former homeowners will find themselves in Negative Equity in relationship to Loan to Value. An estimated 2.4 million homeowners will lose their homes, multiplied by spouse and kids, truly an exodus that would put the Israelites to shame in number.

Question by Tino: During a short sale, does the title get deeded over to the seller before the lender approves the sale?
I am trying to short-sale my property, and I got in contact with a company that specializes in buying short-sale properties. They are asking me to deed the title over to their company while they negotiate with my lender. I don’t feel comfortable signing away the title before the sale is approved, so I’m not going to do it, but I was just curious if this is normal procedure for a short sale.
I read the warranty deed, and it looks like they are wanting me to deed the title into a trust, in which I would be the beneficiary. Does anyone know exactly what this means?
